Terms of service.

The agreement between your business and Gemora when you use the marketplace.

Who may use Gemora

Gemora is a trade-only marketplace. Accounts are open to registered businesses in the diamond and jewellery trade, and are enabled only after we have confirmed that connection. Consumers cannot open an account.

Your account

You are responsible for everything done under your account, including by the users you add to it. Keep credentials secure, tell us promptly if you believe they have been compromised, and keep your company details current — verification depends on them.

Listings and accuracy

If you list stock, you are stating that you own it or are authorised to sell it, that it is available, and that its description, grades and certificates are accurate. Listings found to be inaccurate, duplicated or already sold may be removed.

Gemora does not own the goods listed on the platform and is not a party to the sale between two members.

Trades and settlement

A trade is an agreement between buyer and seller. Where settlement runs through Gemora, payment is released against confirmed delivery, and the goods travel insured through our logistics partners. Memo, hold and return terms are as agreed on the listing.

Fees

◆The first ten diamonds an account trades — bought or sold — carry no listing fee and no commission.
◆After that, access is charged as a flat plan fee. We do not take a percentage of the value of a trade.
◆Plan fees are billed in advance and are non-refundable for the period already started, unless the law says otherwise.

What you must not do

◆List goods you do not hold or are not entitled to sell.
◆Misstate a grade, a certificate or an origin.
◆Use the platform to launder funds, evade sanctions, or trade goods of unlawful origin.
◆Scrape, resell or republish another member's inventory or pricing.

Suspension

We may suspend or close an account that breaches these terms, fails verification, or puts other members at risk. Where we can, we will tell you why and give you a chance to put it right.

Liability

We provide the platform with reasonable care but do not guarantee uninterrupted access. We are not liable for the quality, title or delivery of goods traded between members, or for indirect or consequential loss. Nothing here limits liability that cannot be limited by law.

Governing law

These terms are governed by the laws of India, and the courts of Gujarat have exclusive jurisdiction, unless a mandatory law in your own country says otherwise.
